Key points
- The President is the nominal executive; the Council of Ministers headed by the Prime Minister is the real executive (Article 74).
- The President appoints the Prime Minister (Article 75(1)); by convention this is the leader of the majority in the Lok Sabha, and in a hung Parliament the President uses personal judgement and asks for a floor test.
- Other ministers are appointed by the President on the Prime Minister's advice; the Prime Minister allocates portfolios.
- The Council has three ranks: Cabinet Ministers, Ministers of State and Deputy Ministers.
- The 91st Amendment (2003) limits the Council to 15 per cent of the Lok Sabha's total strength, including the Prime Minister.
- A non-member may become a minister but must enter Parliament within six months (Article 75(5)); ministers take oaths of office and secrecy before the President.
- The Council has no fixed term; it lasts while it keeps the confidence of the Lok Sabha, normally five years.
- It ends early on the Prime Minister's resignation or death, a no-confidence motion, defeat on a confidence vote, or defeat on a money bill or major policy.
- Functions of the Council: policy making, administrative, legislative, financial and emergency.
- A National Emergency needs the written decision of the Union Cabinet (44th Amendment, 1978).
- The Prime Minister is far more than "first among equals": the keystone of the Cabinet arch.
- Powers of the Prime Minister: forming the Council, heading the Cabinet, coordinating ministries, linking the President and the Council (Article 78), leading Parliament and the party, advising on appointments and dissolution, guiding foreign policy.
- Collective responsibility (Article 75(3)): the Council is jointly answerable to the Lok Sabha; ministers swim and sink together.
- Individual responsibility (Article 75(2)): each minister answers for that minister's own ministry and may have to resign alone.
- The Cabinet is the inner core of the Council of Ministers; it is smaller, meets regularly, takes the decisions and binds the whole Council.
